1. Parties and Introduction
All users (“Participants”) who visit this website ([bebekpinkboat.com]), make a reservation, or purchase a boat experience through our website acknowledge, declare, and undertake that they have read, understood, and accepted all the terms and conditions set forth below by Bizim Bebek Deniz Turizmi İşletmeciliği Ticaret Limited Şirketi (the “Company”).
2. Reservation, Duration, and Payment Terms
Reservation and Experience Duration: Participants may make a reservation through our website by selecting one of the Bosphorus boat experience packages lasting 15, 30, or 45 minutes. The selected duration begins when the boat departs from the pier.
Payment: To confirm a reservation, the deposit for the selected experience must be paid in advance. Our prices include weather monitoring, basic safety equipment, and guidance and safety briefing services. No additional taxes or hidden charges apply.
3. Cancellation, Refund, and Adverse Weather Conditions
Adverse Weather and Sea Conditions: The Company may cancel or postpone the experience due to safety risks such as waves, storms, dense fog, or navigation restrictions imposed by the relevant authorities in the Istanbul Strait (Bosphorus). In such cases, the Participant will be offered a free change of date or time or, upon request, a full refund without deductions.
Cancellation by the Participant: For cancellation requests submitted 48 hours or more before the scheduled reservation time, the full amount paid will be refunded. For cancellations made less than 48 hours before the reservation time, or in the event of a no-show, no refund will be issued.
4. Safety, Boat Operation, and Participant Responsibilities
Safety Rules: Before boarding, the Participant must attend the safety briefing provided by the staff and wear a life jacket throughout the experience. If a Participant fails to comply with safety instructions, the experience may be terminated immediately without a refund.
Health Conditions: Participation is not recommended for individuals with heart conditions, panic attacks, pregnancy, or severe back or neck disorders. The Participant is deemed to declare that their health condition is suitable for this activity.
Misuse and Damage: If, while personally operating a Pink Boat, the Participant intentionally or through gross negligence violates maritime traffic rules or causes damage to other vessels or the boat itself, the resulting legal and financial liability shall rest with the Participant.
5. Social Media, Photography, and Video Usage Permission (Personal Data Protection)
Photography and Video Recording: During the experience, Company staff may take photographs and record videos for promotional, commemorative, and marketing purposes, as part of the nature of the activity.
Permission to Publish: By accepting this Agreement, the Participant acknowledges and gives explicit consent, pursuant to the Turkish Personal Data Protection Law (KVKK), to the processing, use, and publication of photographs, videos, and audio recordings taken during the experience on the Company's social media accounts (including Instagram, TikTok, and YouTube), website, and advertising materials.
Withdrawal of Consent: The Participant may contact the Company at any time to request the removal of published images or recordings. The Company undertakes to remove the relevant content within a reasonable period.
6. Limitation of Liability
The Company shall not be held responsible for waves caused by other vessels in the Bosphorus, sudden changes in weather conditions, or the loss or damage of the Participant's personal belongings, including mobile phones, glasses, or cameras, if they fall into the sea or are otherwise damaged.
7. Jurisdiction
Any disputes arising from this Agreement shall be subject to the jurisdiction of the Consumer Arbitration Committees, Consumer Courts, and Enforcement Offices in Istanbul, as applicable under the relevant legislation.
